Abstract

As declared by the European Council in 1993, the protection of human rights, including minority rights, is a condition imposed to the countries of Central and Eastern Europe for joining the European Union. Considering this background, this thesis provides a comparative and up‐todate analysis of minority protection standards in Albania and Bosnia‐Herzegovina as well as at the European level. Absent a community competence for minority protection, European standards for the protection of minorities are derived from soft‐law EC/EU documents, such as EP resolutions, the annual Commission reports, the Opinions of the Advisory Committee on the Framework Convention for the Protection of National Minorities. After seeking to identify a developing common European standard of minority protection, it attempts to report whether the prospect of European integration and the EU’s minority protection conditionality have contributed to regime stability and to democratic consolidation of those countries and whether minority protection as a conditionality requirement for EU accession is comprehensively being applied in the monitoring activities of the EU.
